GENERAL TERMS AND CONDITIONS
1. Scope
These General Terms and Conditions (GTC) in their version valid at the time of the order apply exclusively to all contracts concluded via the online shop at the internet domain www.lederleitner.at or by distance selling. You may download, save, reproduce, and print the GTC on your device (PC, tablet, smartphone, etc.). Any provisions deviating from these conditions shall not become part of the contract unless they have been confirmed by us in writing. The shipment of goods takes place in accordance with the Austrian Consumer Protection Act (KSchG).
2. Contract Language
The contract language is German.
3. Contractual Partner, Conclusion of Contract
Our information regarding goods, products, prices, and discounts within any ordering process is subject to change and non-binding. It does not constitute a legally binding offer but rather a non-binding online catalogue. Your order on www.lederleitner.at constitutes an offer to conclude a purchase contract. You confirm your order by clicking the button “Buy Now” and by accepting the General Terms and Conditions. An order is only possible if all mandatory fields marked with * in the order form are completed.
The purchase contract is only concluded upon acceptance of the offer by Lederleitner GmbH, and a claim to delivery of the goods arises. The automatically generated order confirmation sent by Lederleitner GmbH does not yet constitute acceptance of your offer. Acceptance of the offer occurs only through a separate textual declaration (= shipping confirmation), which is also sent by email, or through the actual dispatch of the goods to you. We reserve the right to reject your contractual offer.
In the event of typographical, printing, or calculation errors on the website, Lederleitner GmbH is entitled to withdraw from the contract. Only the goods listed in the shipping confirmation will be invoiced. No purchase contract is concluded for goods not included in the shipping confirmation.
Your personal data is highly sensitive and will be treated as such by Lederleitner GmbH. You must not disclose the password required for ordering to third parties. In the event of disclosure, you shall also be responsible for orders placed by third parties. You are liable for all orders placed using your password and any resulting claims.
4. Shipping
The stated shipping costs apply to all products that can be purchased directly in the webshop. Excluded are all products that are only available upon request. Shipping of small and large furniture is only possible within Austria. In addition to the stated product prices, shipping costs apply depending on the size of the items. The amount of shipping costs depends on the dimensions and weight of the goods to be shipped:
- For small items € 7.50
per delivery (postal shipping, valid in all federal states)
- For small furniture € 45.00
per delivery (postal shipping, valid in all federal states)
- For large furniture or bulky products
- Vienna € 120.00
- Lower Austria, Upper Austria, Salzburg, and Styria € 150.00
- per delivery, delivered curbside by forwarding agent; tariff does not apply to the federal states of Vorarlberg, Tyrol, Carinthia, Burgenland. For deliveries to these federal states, we are happy to provide an individual quote for the shipping costs.
- If a delivery includes multiple products with different shipping tariffs, the highest applicable tariff shall apply.
We deliver while stocks last.
- Comfort Delivery
If you request a comfort delivery, we will contact you regarding the additional costs and your preferred delivery date. In a comfort delivery, the goods are carried to the designated installation site and assembled. Packaging material will be taken back and disposed of by us. Any shipping costs already charged in advance for the respective delivery will be deducted from the actual delivery costs. You are obliged to accept the ordered goods on the agreed date. If delivery cannot be completed on the agreed date due to reasons attributable to you, we are entitled to charge the costs of a renewed delivery.
5. Payment
The following payment methods are available in our online shop: Credit card: Your credit card (MasterCard and Visa) will be charged upon completion of the order. Instant transfer: We also offer instant transfer.
We receive the transfer credit immediately, which accelerates the entire ordering process. You only need account number, bank code, PIN, and TAN. With Sofort by Klarna, you can pay online easily and conveniently using your familiar online banking data. You will be redirected to a Klarna interface. After entering your country and bank code, you can log in with your online banking details. All important purchase data will be automatically transferred from the shopping cart. You only need to confirm the payment by entering the TAN.
You may only offset claims against us if they are undisputed or legally established.
6. Self-Collection
During the online ordering process, you may also select the option reservation in store. Collection of reserved goods at our Lederleitner branches is only possible during the respective opening hours (see: https://www.lederleitner.at/standorte). Goods will be reserved for a maximum of 48 hours in the selected branch.
7. Parcel Lockers
We do not deliver to parcel lockers.
8. Retention of Title
All goods remain the property of Lederleitner GmbH until full payment of the invoice amount.
9. Storage of Contract Text
You may view and download the GTC at any time at www.lederleitner.at. Your past orders can be viewed in your customer login.
10. Pricing
All prices are stated in euros and include the applicable statutory VAT. No liability is assumed for printing errors or for the accuracy of information. We deliver while stocks last.
For each delivery, the shipping fee communicated before placing the order in the online shop applies. In the event of price changes due to circumstances beyond our control (customs duties, collective agreements, taxes, etc.) between the shipping confirmation and delivery of the goods, we are entitled to adjust the price stated in the shipping confirmation, either increasing or decreasing it, until delivery.
11. Warranty
In the event of defects, the statutory warranty provisions apply.
We assume no liability for defects/errors resulting from improper or unintended use of the goods. Manufacturer information must be observed. You lose any warranty claims if you or unauthorized third parties intervene in the goods or carry out repairs or attempts at repair.
The following provisions apply exclusively to business transactions:
The burden of proof that a defect existed at the time of delivery lies with the entrepreneur.
The reasonable period for notification of defects pursuant to § 377 UGB is set at 7 days from delivery of the goods.
12. Damages
Claims for damages are excluded in cases of slight negligence. This exclusion does not apply to personal injury or damage to items entrusted for processing.
The entrepreneur must prove gross negligence or intent on our part.
We are not liable for indirect damages or loss of profit.
Withdrawal by the entrepreneur due to delay in delivery is only permissible after the expiry of a reasonable grace period of at least 4 weeks set by the entrepreneur.
Claims for damages by the entrepreneur against us may only be asserted in court within eight months from knowledge of the damage, but at the latest within three years from the event giving rise to the claim.
Jurisdiction
All contracts concluded via our online shop or by distance selling are subject exclusively to Austrian law, excluding the conflict-of-law rules of private international law and excluding the UN Convention on Contracts for the International Sale of Goods.
This choice of law does not affect mandatory consumer protection provisions of the country in which the buyer has their habitual residence.
The place of jurisdiction and place of performance is Krems, unless you are a consumer.
If individual provisions of these GTC are legally ineffective, the remaining provisions and contracts concluded on their basis remain valid. The parties are obliged to replace the ineffective provision with a valid one that most closely reflects its purpose.
Right of Withdrawal
If you are a consumer, you have a right of withdrawal for distance contracts in accordance with the Distance and Off-Premises Contracts Act. You therefore have the right to withdraw from this contract within 14 days without giving any reason.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post, fax, or email).
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (except for additional costs arising if you chose a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within 14 days from the day on which we receive notification of your withdrawal. For this reimbursement, we will use the same means of payment as you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees for this reimbursement.
We may withhold reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods without undue delay and in any event no later than 14 days from the day on which you inform us of your withdrawal, to

The deadline is met if you send back the goods before the period of 14 days has expired.
Exceptions to the Right of Withdrawal
There is no right of withdrawal for goods that are made to customer specifications or clearly tailored to personal needs, and for goods delivered sealed which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

If the goods show signs of use or damage upon return, we reserve the right to assert claims for compensation. To help us improve our service, please include the return form in the package and indicate the reason for return.
